Council commenced Class 4 proceedings in the Land and Environment
Court seeking declaration that the Minister's opinion was

Justice
Lloyd held that the Minister's opinion related to the original
D.A., not the amended D.A. Therefore the Minister's opinion
was of no effect and the consent authority
was Pittwater Council. Austral Monsoon appealed and the
Council and the Minister cross-appealed. |

Monsoon advises that they intend to amend the application
and to seek the leave of the Court to rely on the amended
